Quick question about taking maternity leave before your due date.?
I am due on May 18th but have had the plan to work up until that date, or even waiting until I go into labor just so I could have as much time with my baby after she’s born as possible. I dont want to waste any time being off before hand if I can help it. Well I was told this morning that taking off before your due date will not cut into your 6-8 weeks of disability leave. She said the leave starts once you give birth and that you can take a few weeks off before you give birth and still get disability pay, but still keep your 6-8 weeks after giving birth. Is this true?
I have my apt. with my doctor on Monday so I am going to ask her but I wanted to try and research it today as well.
Also, I live in California. Does anyone know about FMLA? It doesnt get filed until the 6-8 week disability leave is taken, right? Sorry about all the questions…my human resources department has not been very helpful!!
Leaving early will not affect your STD because that starts the day you are hospitalized for the birth. It will affect your FMLA though because FMLA is only 12 week tops (including the 6-8 weeks that are paid by STD). If you want your job when you return you cannot be gone longer than 12 weeks total for the entire maternity leave.
