State disability vs. Work benefits & maternity leave?
I am due for my first child on 11/28/09 which is this Saturday. I have officially started the state disability program so I can have funds coming in, which started today 11/23/09. At my work, we are paid for holidays. I will be on disability for Thanksgiving, Christmas, and New Years. I asked my HR and she says that I am not paid for holidays through the company because I am on disability. I don’t find this fair, because I meet the requirements of the 32 hour / week minimum to receive benefits. HR also says that I am not allowed to collect my Vacation or Sick time during my disability. This is all news to me, as I was really depending on that time that I have saved up from sick and vacation, and getting the holidays also to make ends meet during my maternity leave. Does anyone have any advice or who should I go to for help on this?
you are probably stuck on that one… usually the company will make you take all your sick and vac time BEFORE disability can start.. but since this is state i guess that doesnt count.. on disability you cant get holidays as your pay is fixed for the week irreguardless of holidays… in a usual setting, you generally cannot take a holiday pay if you missed the day before or after work in some companies… if you were paid anything from your company, it would violate your disability pay.
