Maternity Leave Laws Illinois
August 4th, 2009 by admin

Can you help with Maternity Leave Questions?

I have done a lot of research regarding US Maternity Leave Laws and found a lot of helpful information about FMLA and the sort…but all of these laws apply to companies who has a total of 50 employees or more. My problem is that the company I work for is small, very small. Total of 7 employees. I cannot find any information for the laws of Illinois regarding maternity leave for small businesses. I have looked in my ‘employee handbook’, but it just states that after one year of employment someone would be eligible, but that’s about all it says. I have not done the common sense thing of speaking to my HR because I don’t want anyone assuming I’m pregnant and start harrassing me about it …i just want facts to be able to prepare myself for the near future. Can anyone help? Please be as specific as possible and provide all the links you can! Thank you soo much in advance!!! :-)

Some states have maternity laws others dont. I live in CO and we are covered under FMLA but no laws just for our state.
If this is the case with your state, then your only optio is to speak with your HR Rep as your company probably has its own policy. Just remember that they can’t fire you for being pregnant or needing time off. Also look into purchasing a short term disability plan, as pregnancy falls under shortterm disability after you have the baby.
