What are your options when you go out on maternity leave?

How long and how much do you get from NJ disability? Do you get SSI and for how long? I pay into a short term disability for how long will I get it? What are my FMLA rights? I know that Governor Corzine recently signed legislation that will provide New Jersey employees with up to six weeks of paid family leave under the state’s temporary disability insurance program. The law goes into effect July 1, 2009. This benefit will be 100% paid by the employee, but when will I get it?

Okay, a lot of questions here.

How much and how long do you get from NJ disability: For a normal pregnancy, benefits are usually payable for up to four (4) weeks before the expected delivery date and up to six (6) weeks after the actual delivery date (provided that you have not worked during that time). A doctor may certify that you are disabled for a longer period if:

You experience specific complications related to pregnancy.
You undergo a Cesarean section.
You have another simultaneous disability.
You are physically unable to do your regular job

You should not be eligable for SSI.

FMLA only counts if you work for a company that has more than 25 employees i believe, and even then you basically file the paper work and it means that for a period of 6 weeks they have to let you have UNPAID leave, and they have to let you have your job back even though you left for up to six weeks.

As for the disability insurance that goes into effect, I would google the law and make sure you are not grandfathered out of it…it may be too late for you to use.

Typically any diability insurance or state provided disability has a lag time of at leat 2-3 weeks, so don’t depend on those checks to roll in, in any short amount of time. Paper work takes time, and you can’t even file until you are totally out of work, for what ever reason.
